Hydra Web Services (HWS) – Terms of Service Agreement

1. Overview of the Website and Services
Hydra Web Services provides this Terms of Service Agreement which relates to our entire website and services we provide. By viewing, signing up to any area on our website you agree to be bound by this Agreement. Please make sure you read this Agreement in full. If you have any concerns you can submit a ticket via our HelpDesk to get the information or raise your concern with any part of this Agreement.
Hydra Web Services will not provide any personal information to any third party, apart from a sub-contractor that may be hired to work on or provide other services to you via Hydra Web Services. Our sub-contractors are under strict confidential procedures with our business and will not provide your personal information to any other party. Also, we will only provide the needed information to provide the service and nothing more.
2. Age Limit for Services
Hydra Web Services and our Services are intended for those over the age of 16. We will not provide services to anyone under the age of 16 years.
Hydra Web Services has the right to request ID confirming that a potential client is over the age of 16 years. If you do not provide ID upon request we will deny any and all service(s) to you until such time as ID is provided.
3. Financial Information
You agree to pay Hydra Web Services for all services provided on time and when requested. Late payments may incur a late fee being added.
Payments can only be made via Direct Bank Deposit or Cash (for people living within Australia) or PayPal (for all other clients). We do not accept cheques, this goes for business or personal cheques. If you wish to use another method please contact our Sales Department through the HelpDesk
Prior to Hydra Web Services beginning to provide services to you, you agree to pay a 75% deposit (50% non-refundable) for services as provided in your Invoice. An exception to this is domain names (which are paid annually) and web hosting (which is paid either monthly, quarterly or annually).
Any work performed outside of normal business hours (Mon – Thurs 9am to 5pm (AEDT – GMT+10) and Sat 10am to 2pm (AEDT – GMT +10), no matter the plan or current services you are being provided (unless stated otherwise in your contract) will result in an after-hours fee being charged and an extra payment for work provided outside normal business hours. Failure to pay for said service may result in the termination of all current services being provided to you until such time as payment is made. This is not negotiable and payment will be required at time of contact and prior to work being done after-hours.
If you or HWS suspends or cancels your account you may be liable for a suspension or cancellation fee depending on the situation. This is at the sole discretion of management.
4. Compliance with the Law
You agree that any content and or information you provide to Hydra Web Services is truthful and not illegal or against any laws.
Hydra Web Services will comply with any Police / Federal Agency upon an official request in writing or via a court order.
5. Termination of Services
You can request to terminate or cancel your service(s) with Hydra Web Services. This must be done in writing by submitting a ticket to our Sales Department via our HelpDesk.
The HWS Terms of Service Agreement shall be effective immediately when you begin to use of our website or service(s) and shall continue so long as you continue to use our website or service(s), or until your use of our service(s) is terminated by either You or Hydra Web Services.
Hydra Web Services may suspend or terminate your service(s) at any time, for any reason at the discretion of our Management Team. You will be contacted via us opening a ticket in our HelpDesk and making contact with you.
6. Changes to this Agreement
Hydra Web Services may modify any part of this Terms of Service Agreement at any time without prior notice.
Any modifications to our Terms of Service Agreement will be posted on our Social Media pages and on our website. It is then your responsibility to make sure you then review any updates to this Agreement.
7. Limitation of Liability
Under no circumstances will Hydra Web Services, our Team or Sub-Contractors be liable or responsible for any direct, indirect, incidental, consequential (including damages from loss of business, lost profits, litigation, or the like), special, exemplary, punitive, or other damages, under any legal theory, arising out of or in any way relating to our website or service(s), except as required by law. Your sole and exclusive remedy relating to your use of the site or the service(s) shall be to discontinue using our website and our service(s).
During your time as a customer at Hydra Web Services, we may use sub-contractors at any time we see fit in the development of your website or another service we provide to you. Sub-contractors will be paid by Hydra Web Services through the finances you pay to Hydra Web Services to the service(s) provided to you. Failure to make payments when a sub-contractor is involved may result in us providing your information to this sub-contractor to collect any money outstanding to them via any means they see fit.
The failure of Hydra Web Services to exercise or enforce any right or provision of this Terms of Service Agreement shall not operate as a waiver of such right or provision.
